research group: Dignity of the human person and the social function of the state

The Research Group “Dignity of the Human Person and the Social Function of the State” is intended to provide to its participants the combination of teaching and extension, with the Masters in Law program of Centro UNISAL, Unit of Lorena, based on the study of practical cases connected to several themes which are applicable to it.

Its main idea consists of integrating, in order to join forces, researchers, masters, PhDs, master’s candidates of Master’s Degree of UNISAL and academics of Law School, counting on the support of partner institutions, by means of its professors.

Besides, the Group aims creating means to amplify research and scientific production by master’s candidates and graduate students in Law, generating results to be published in books, judicial journals qualified by Qualis or presented in national and international scientific events.


In the field of the Human Rights theme, combined with the recent national history, several challenges are detected and they cannot in any way be ignored.

Thus, starting from de discussion of practical cases, the group members will have the opportunity to exceed the limits of theory to present their conclusions, always based on a strict methodological control, in an interdisciplinary and propositive perspective.

The Human Rights and the Social Rights will be analyzed inside the reflection of the social function of State as a decisive entity of the public policies related to the studied themes, what allows the discussion opening for several branches of law, such as Constitutional Law, Administrative Law, Environmental Law, Criminal Law, etc.

The proposal of the Master’s in Law Program of Centro Universitário Salesiano de São Paulo, São Joaquim Unit of Lorena, aims the education of professionals who are aware to research and reflection about the reality, so that they are capable of acting to promote the transformation of the environment and the society that they live and act in, searching for the common good.
Because of this, this project has social and scientific relevance.

The present group is integrated to the other research groups of the Masters in Law Program of Centro UNISAL of Lorena-SP.

The necessity of investigation on the theme has been amplified in face of the worsening of the human rights violation.
Thus, we count on researchers and students of Campus São Joaquim - UNISAL, acting in a coordinated way with the masters in law program of UNIFIEO - Osasco-SP, as well as other areas of knowledge, such as Science and Technology Institute of UNESP/SJC.
The studies and research results are presented in national and international congresses and seminars such as UFF, CONPEDI, UBA (Argentina), SEMIDI (UNISAL) and book chapters, as well as the publication in scientific journals indexed to Qualis.

theoretical foundation
The study of the achievement of the Dignity of the Human Person in face of the social function of the State arises from the necessity of a reflection from the fundamental values which must be aimed and introduced in Brazilian reality, in order to seek the inclusion of the largest component of population in the context of the guaranteed rights by the Major Charter of 1988.
In this respect, Thais Cavalcanti claims:

The promotion of the fundamental rights and people’s capabilities imposes to the State a form of acting to create opportunities for people to act and choose certain goods which help in their growth and development.(2015, p. 133)

In addition, the author continues:

The public policies promoted by the Executive Power should attend, as main objective, the creation of opportunities for people to develop. It is important to notice that the Executive Power represents directly the Government elected by the population, with a determined ideology which interferes in the means used in the achievement of results.(2015, p. 133-134)

The law operator has, therefore, essential social function for the formation and transformation of the society as well the diffusion and promotion of the Human Rights with a view to the promotion of the ideal of dignity of the human person in the context of diverse public policies to be adopted by the State.

After all, the Federal Republic of Brazil is a Democratic State of Law and it has, among several foundations, the dignity of the human person (article 1, item III, at the Federal Constitution of 1988).

Even though the dignity is inherent to the human being, the State must promote means for this dignity to be completely attended.

The Federal Constitution of 1988 is qualified as “Citizen Constitution” for bringing in its core countless regulations of social and economic nature, which brings a great concern with the fundamental rights said as of second dimension, which are the social rights.

The present research group focuses on this theme, which aims to explore this social function of the State, in the pursuit of the achievement of fundamental social rights as a way of promoting the dignity of the human person.

The field for research is very wide and comprehensive, prioritizing interdisciplinarity an plurality, the reason why, in these terms, this research group has great importance for the participation of professors of other areas, such as Environmental and Civil Engineering.

In addition to the study of the fundamental social rights, dignity of the human person and the relation between them, there will still be the approach of effectiveness, efficiency and achievement of the social rights as a way of promotion of dignity of the human person, from public freedoms, such as protection to freedom of religion and fundamental rights related to childhood and youth, to the elderly, in which research in the tributary, economic, administrative, insurance and urban field, among others, will be admitted to reach this purpose.

The research foundations are the principle of the dignity of the human person in its main philosophical bases with the respective conceptions of justice and the Democratic Rule of Law, which cover directly the recognition of the fundamental freedoms, the democratic procedure and substantial public policies which expand the citizens’ capacities.

The systematic and theological interpretation will ground all the researches, according to neo-constitutionalism, with the insertion of concepts such as principles, rules and postulates, especially with the use of consideration of values for the solution of constitutional contradictions involving the fundamental rights, in spite of the application of the argumentation theory.

The constitutional hermeneutics will be an inseparable constant in the studies of the social function of the State for the promotion of the dignity of the human person, in diverse research lines inserted in the studies group.


At the beginning of the academic year, a public notice will be published, inviting the interested students to the research groups’ inaugural meeting.

At the mentioned notice, the group’s name and its proposal will be included, according to project approved by the Master’s Degree Coordination.

At the first meeting, the Professor Group Leader will present to the interested ones the objectives and guidelines of the research group, as well as the practical case to be studied.

Over the following week, the participant students will be assigned to perform a research, even succinct, about the legal themes related to the case, with a view to oral exposition.

At the following meeting, the researchers will present their conclusions, always indicating the source from which the information appeared, following the applicable rules to the Scientific Research Methodology.

Two coordinators will be designated, one student in the Master’s Degree and the others, preferably, 4th or 5th year Graduation students.

The coordinators’ function, in addition to preside the meetings with the Leader and Vice Leader Professors of the Group, consists in helping the establishment of work guidelines over each academic semester, as well as stay available to the participant students to guide them to search for information about the proposed theme at the library.

The other Professors of the Master’s Degree participants in the Group will follow their guided students’ participants in the works, to elaborate researches relating to the proposed case.

There is no obligation to conclude the practical case in the following meeting, and it might occur that a same problem can be analyzed until exhaustion during the academic year.

Each meeting will contain an attendance list and a minutes, in which the graduating coordinator, under the master’s candidate, Leader and Vice-Leader Professor’s supervision, will register the main points brought by the participant members about the case.

The master’s candidate and graduation student coordinators, together with the Leader and Vice Leader Professors, will elaborate a compilation of practical cases, to be conveniently published for use in the meetings.

As a complimentary but not less important activity, each research studies group member will be invited to elaborate, based on the researched material and under the guidance of any of the group member Professors, a scientific article which will be object in Scientific Congresses.

If a student shows interest in deepening in a theme which is not connected to the discussed case, it will be also admitted as long as there is relevance for the theme of the group.
